Overview

En el Informe de Salud Laboral 2004 se identifican algunos problemas estructurales en el mercado laboral y la estructura productiva española, que dificultan la aplicación de las políticas de prevención de riesgos laborales: entre ellos, cabe señalar la baja calidad del empleo caracterizado por una temporalidad muy alta, sobre todo en mujeres y jóvenes, a lo que hay que añadir la inmigración, y el elevado número de microempresas.

Los recientes cambios en el marco normativo tratan de hacer frente a estas realidades, insistiendo en la imprescindible coordinación empresarial, si bien la negociación colectiva sigue siendo muy débil en este campo. Queda pendiente de reforma la definición de las responsabilidades empresariales, que la oriente hacia la prevención y la protección del trabajador lesionado.

Existe un evidente déficit de información sobre las condiciones de trabajo y los riesgos laborales, en los que deberían de basarse las políticas preventivas, no tanto en las consecuencias. Las encuestas sobre condiciones de trabajo son necesarias, y deben mejorarse, pero son insuficientes, pues tendrían que complementarse con estudios de campo sobre riesgos higiénicos, ergonómicos, psicosociales y de seguridad.

La incidencia de las lesiones por accidentes de trabajo están disminuyendo, como era de esperar, dado los cambios en los procesos productivos, tal como está ocurriendo en otros países de nuestro entorno, pero las enfermedades laborales y relacionadas con el trabajo están aumentando, especialmente las musculoesqueléticas y las mentales.

Ante esta realidad, la administración laboral central cuenta con una Inspección de Trabajo que no crece al mismo ritmo que la población a proteger, especialmente en las comunidades autónomas con mayor crecimiento económico (Madrid, Cataluña y Comunidad Valenciana), y un Instituto Nacional de Seguridad e Higiene en el Trabajo que no acaba de asumir su papel de centro de investigación de referencia.
